Welcome to EvoFine. These Terms of Service ("Terms") apply to your use of evofine.com (the "Site") and any purchase you make from EvoFine LLC ("EvoFine," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to make a purchase on the Site. If you are younger, you may use the Site only with the involvement of a parent or guardian.

If you create an account, you agree to provide accurate information and keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Please contact us right away if you believe your account has been used without your permission.

2. Products and descriptions

We work hard to describe and show our products accurately. However, colors may look different depending on your screen, and product packaging or minor design details may change from time to time. Product images are for illustration, and specifications are provided by our manufacturers. If a product you receive is materially different from its description, you may return it under our Refund and Return Policy.

3. Pricing and availability

All prices are shown in U.S. dollars unless stated otherwise. Prices, promotions, and product availability may change at any time without notice. Applicable sales taxes and shipping costs are added at checkout.

Occasionally, the Site may contain errors in pricing, descriptions, or availability. We reserve the right to correct any error and to cancel orders affected by an error, even after an order has been placed. If we cancel an order you have already paid for, we will refund you in full.

4. Orders and payment

Your order confirmation email means we have received your order, but not that we have accepted it. We may limit quantities, or refuse or cancel any order, including orders that appear to be placed by resellers or distributors, orders that fail fraud screening, or orders with incorrect information. If we cancel a paid order, we will issue a full refund.

You agree to provide current and accurate payment and billing information, and you confirm that you are authorized to use the payment method you provide. Payments are processed securely by our third-party payment providers, and EvoFine does not store your full card details.

5. Shipping, returns, and refunds

Shipping times, costs, and delivery details are explained in our Shipping Policy. Returns, exchanges, cancellations, and refunds are covered by our Refund and Return Policy. Both policies are part of these Terms. Risk of loss passes to you when your order is delivered to the carrier, but we will still help with lost or damaged packages as described in our Shipping Policy.

6. Product use and safety

Please read and follow all instructions, warnings, and safety information included with your products. This is especially important for electrical products such as hair dryers, chargers, and rechargeable devices. Use them only with the correct voltage, keep them away from water unless they are labeled waterproof, and keep them out of reach of children.

Our products are designed for personal, everyday use. Products such as seat cushions are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. Please talk to a healthcare professional about any health concern.

7. Reviews and content you submit

If you post a review, photo, comment, or other content on the Site or send it to us, you confirm that it is honest, that you have the right to share it, and that it does not violate anyone's rights or any law. You give EvoFine a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business, including on our website, marketplaces, and social media.

We may remove content that is offensive, misleading, unlawful, or unrelated to our products. We do not edit reviews to change their meaning.

8. Intellectual property

All content on the Site, including the EvoFine name and logo, text, product images, graphics, and design, is owned by or licensed to EvoFine and is protected by copyright, trademark, and other laws. You may view and share Site pages for personal, non-commercial use, but you may not copy, reproduce, modify, or sell any content without our written permission.

9. Prohibited uses

When using the Site, you agree not to:

Break any law or violate the rights of others
Place fraudulent orders or use payment methods you are not authorized to use
Upload viruses, malicious code, or anything that could harm the Site or its users
Scrape, copy, or collect data or content from the Site using automated tools without permission
Try to gain unauthorized access to the Site, other accounts, or our systems
Post false, misleading, or abusive reviews or content

We may suspend or close your account or block access to the Site if you break these Terms.

10. Third-party services and links

The Site is powered by Shopify and uses third-party services for payments, shipping, and other features. The Site may also link to websites we do not control, such as marketplaces or social media platforms. We are not responsible for third-party websites, services, or their content, and your use of them is subject to their own terms and policies.

11. Disclaimer of warranties

Except as expressly stated in these Terms or in a written warranty included with a product, the Site and all products are provided "as is" and "as available." To the fullest extent allowed by law, EvoFine disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will always be available, error-free, or secure.

Some states do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

12. Limitation of liability

To the fullest extent allowed by law, EvoFine and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or any product. Our total liability for any claim related to a product or order will not exceed the amount you paid for that product or order.

These limitations do not apply to liability that cannot be limited under applicable law, such as liability for death or personal injury caused by our negligence.

13. Indemnification

You agree to defend and hold harmless EvoFine and its owners, employees, and partners from any claims, losses, or expenses, including reasonable legal fees, arising from your violation of these Terms, your misuse of the Site or products, or your violation of any law or the rights of others.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict of law rules. If you have a concern, please contact us first, as most issues can be resolved quickly and informally. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Dallas County, Texas, unless the consumer protection laws of your place of residence give you the right to bring a claim elsewhere.

15. General terms

Privacy: our Privacy Policy explains how we collect and use your personal information.
Changes: we may update these Terms from time to time. Updated Terms will be posted on this page with a new effective date and will apply to orders placed after that date.
Severability: if any part of these Terms is found unenforceable, the rest will remain in effect.
No waiver: if we don't enforce any part of these Terms, it does not mean we give up the right to do so later.
Entire agreement: these Terms, together with our policies linked above, are the complete agreement between you and EvoFine about your use of the Site.
